Appeal against Yelland plan for 53 homes dismissed

Inspector says 11 affordable homes out of 53 is ‘not enough’.

A government inspector has dismissed an appeal over plans for 53 new houses in Yelland because there wasn’t enough affordable homes in the scheme.

Inspector Mike Robins said developer Len Tanner’s proposal for 11 of the new properties at Allenstyle to be ‘affordable’ was not enough.

Echoing North Devon Council’s rejection of the proposals in February, Mr Robins said the benefits of the scheme did not outweigh the harm.

Mr Tanner’s plans had proposed 11 per 20 per cent of the homes be affordable, but the inspector said a viability assessment, which supported that figure, did not appear to have been based on the expected affordable housing levels set out in the Local Plan and Supplementary Planning Guidance (SPG).

“I consider that significant weight should be attached to the failure to demonstrate provision of sufficient affordable houses,” Mr Robins’ report said.

“This is an area of considerable need, and development of green field sites on the edge of existing residential areas present opportunities to address this.”

Residents had also aired concerns about flooding and traffic issues.

Mr Robins said an agreement to show the applicant would provide highways contributions, including improvements to Roundswell Roundabout, had not been available when making his decision.

He said although Mr Tanner had indicated a willingness to meet this, and the council indicated it intended to complete the agreement, but were waiting for signatures from the county council, he did not have a signed agreement before him.
