Guidance to schools on photographing of children

We work closely with Devon County Council – the education authority – over the use of photographs at schools and playgroups.

The county council has a policy which involves schools writing to all parents at the start of a school year and asking if the parents have any concerns about their child/children being photographed by newspapers. The county press office says this is an opt-out policy – schools assume that if parents do not reply to the correspondence that they are happy with the arrangment.

The press office said: "Our schools invite parents to opt out. Unless they tell us, we will assume that all is OK to have press photographers at events. It is not the local education authority policy to have a blanket ban."

Schools and parents should assume that any picture taken for publication in an Archant newspaper may also appear on one of our websites.

The Code of Practice, which is drawn up by the Press Complaints Commision, sets out the rules by which newspapers operate.

The code is very clear about how newspaper must conduct themselves when dealing with children:

Its says: "Pupils must not be approached or photographed while at school without the permission of the school authorities."

In effect, schools and playgroups take on the role of "parental care" in the absence of the mother and father.

Archant reporters and photographers only ever go into schools and playgroups at the invitation of the headteacher or a suitably senior person.

We were invited along by numerous schools and playgroups just before Christmas to take photographs at Nativity Plays – in the same way we are asked along to take pictures of children who are taking part in sports events.

If parents are unhappy to have their child's photograph taken by the press for use in newspapers and on newspaper websites they should draw this to the school or playgroup's attention. Staff should then inform reporters or photographers when they visit the school.

If you would like to contact the county council press office, please ring 01392 383264 and ask for Peter Doyle, head of the unit.
