Ilfracombe man fraudulently spent thousands-of-pounds on Xbox games

The unemployed 20-year-old was ordered to pay back more than £2,000 which he spent on his father’s credit card.

AN Ilfracombe man racked up more than £2,000 on his father’s credit card on Xbox games without his permission, North Devon Magistrates’ Court heard on Friday.

Daniel Holmes, 20, of High Street, Ilfracombe, pleaded guilty to fraud by false representation between January 29, 2013, and January 20 this year.

Ian Holmes was only alerted to the activity on his card when someone who was doing bookkeeping for him spotted the anomalies.

After checking with his bank, Mr Holmes confronted his son who admitted using the card details and offered to pay the money back.

At an earlier hearing Holmes claimed he was given the card details when he invested in his father’s business. The court found Holmes was ‘not being fraudulent from the outset’ as his father was ‘very liberal’ with his card details, said Tim Hook, defending.

Prosecutor Lyndsey Baker said there were 77 payments in total, which had been used to buy Xbox games and ‘coins’ online.

Magistrates heard Holmes was on benefits and his father only contacted the police after realising his son would not be able to pay off the debt.

Holmes was sentenced to pay back the £2097.88 in compensation, but magistrates said they were ‘not going to get involved in the matter of interest payments’.

They also ordered him to carry out 100 hours of unpaid work.
