The 76-year-old admitted breaking the order and a conditional discharge less than 12 hours before it was due to end.

A PENSIONER appeared in court today (Fri) admitting breaching a restraining order and a conditional discharge – less than 12 hours before they were due to end.

Brian Fewings, 76, of Signal Court, Braunton, was not supposed to have any contact with his ex-partner Ann Jones after the six-month order was put in place in June.

North Devon Magisrates’ Court heard Fewings had adhered to the order but on December 6 he was shopping in the village when he saw her sat on a bus.

Tony Dart, defending, said his client had forgotten about the restraining order, which was due to end at midnight, and ‘couldn’t resist just saying something’.

Fewings mouthed through the bus window at Ms Jones calling her a liar, to which the court heard she swore at him and turned her back to him.

He then returned the gesture, flicked the window and walked off. The whole thing ‘was over in the blink of an eye’, said Mr Dart.

The couple had been in a ‘brief’ relationship after the death of Fewings’ wife, but after Ms Jones had called it off ‘very suddenly’ he had queried why and this led to the original harassment charge.

Magistrates fined Fewings £110, and at the request of Ms Jones issued a second restraining order to run for 12 months.
